  • Selective Prosecution • Violated Constitutional Rights • Abuse of Gang Enhancements

    Who Is Richard Holt Jr.?

Richard Holt Jr. is a pro per inmate in San Bernardino County representing himself in court. He’s fighting for his freedom against a deeply unfair and corrupt prosecutorial effort—one driven not by justice, but by bias, retaliation, and unchecked authority.

Despite clear evidence showing he was not at the crime scene — including GPS monitor data — Richard is facing a potential life sentence, not because of the law, but because of the people enforcing it.

    Corrupt Individuals Behind the Case

    • Two deputies involved in Holt’s original arrest are also tied to the prosecution team.
    • One deputy is part of the Gang Task Force, and the other was involved in a search warrant that led to an unauthorized cell search of Holt’s legal materials.
    • Holt’s motions and court documents were taken or destroyed, interfering directly with his ability to represent himself.

    Constitutional Rights Violated

Richard Holt’s constitutional rights have been violated repeatedly:

    • 1st Amendment – Denial of access to the courts by interfering with legal materials.
    • 5th & 14th Amendments – Violation of due process through selective prosecution and misconduct.
    • 6th Amendment – Right to a fair trial denied by misconduct and targeting of a self-represented defendant.
    • 8th Amendment – Excessive and unjust gang enhancements used to threaten a life sentence for a burglary charge.

This Is Not About a Broken System — It’s About Corrupt People

The injustice in Holt’s case doesn’t stem from the law itself, but from the individuals abusing their authority. This is not a system failure — it’s a deliberate violation of rights by those sworn to uphold them.

🔍 Facts the Public Needs to Know

Richard Dean Holt Jr. is currently facing a felony prosecution in San Bernardino County that raises serious constitutional concerns. As a pro per (self-represented) defendant, Mr. Holt has alleged that his legal materials were illegally seized during a jail cell search at High Desert Detention Center on December 27, conducted by Sgt. Travis Kane.

This search lacked a warrant, and multiple documents critical to Mr. Holt’s defense were taken or destroyed, impeding his constitutional right to a fair trial. Despite having GPS data showing he was not at the crime scene, Mr. Holt is being prosecuted under charges inflated by gang enhancements that expose him to a life sentence.

Notably, two deputies involved in his arrest and prosecution — Deputy Bray and Deputy Geerling — are both listed on the Giglio/Brady disclosure lists, meaning they have prior documented credibility issues, such as misconduct or dishonesty, that could compromise their reliability as witnesses. These lists are used nationwide to ensure that officers with histories of misconduct are not allowed to testify without disclosure to the defense

    Call to Action

    We are urgently seeking:

    • Pro bono attorneys to help fight for Holt’s rights.
    • Legal and investigative support to document and expose misconduct.
    • Public support to demand accountability in San Bernardino County.

  • Richard Holt Jr., a pro per (self-represented) inmate in San Bernardino County, is currently facing a life sentence — not because the evidence points to guilt, but because his constitutional rights have been trampled by a system corrupted by selective prosecution, abuse of gang enhancements, and due process violations.

The Charges: A Burglary Case Turned Into a Life Sentence

Holt was originally facing a non-violent burglary charge. Despite GPS monitor data showing he was not at the scene of the alleged crime, his case was inflated into a potential life sentence through the strategic application of Penal Code §186.22 gang enhancements — a prosecutorial tool often abused to increase sentencing exposure, even when there’s no clear evidence of active gang participation.

Destruction of Legal Materials While Representing Himself

While preparing his defense as a pro per inmate at High Desert Detention Center, Holt’s legal rights were blatantly violated. A deputy who was part of both the investigative unit and the gang task force searched his cell — under a warrant tied to the same case — and destroyed legal documents, motions, and evidence that were critical to his defense.

This action constitutes a direct violation of:

    • First Amendment rights (access to courts),
    • Sixth Amendment rights (right to prepare a defense),
    • and Fourteenth Amendment due process protections.

No Independent Oversight. No Fair Shot.

Despite the clear misconduct, no independent investigation has been initiated. Holt, without the benefit of appointed investigative support, is left to fight a system stacked against him — where prosecutors, deputies, and investigators appear to work hand-in-hand, unchecked and unaccountable.

Why This Matters: Pro Per Rights Are Under Fire

This is not just about one man. It’s about a pattern in San Bernardino County — where inmates who choose to represent themselves or challenge gang enhancements are often punished through procedural sabotage, intimidation, or strategic neglect.
